the mail he had was only semi unique, why not use it? he was level 16 as well.. so he becomes a lowbie when it comes to the fact that he shouldn't use uniques, but he is not when when it comes to killing him?

I haven't been paying attention to the crude armoury log (it doesn't log what's in containers, just floor), but if I had to guess I'd say that was all that was left in the armoury after deaths either by Winnetou or others.
Why he had that at his lvl? If I see a lvl 5 with mels,whip,mmail,etc.. I will kill him and Iarak wasnt lowlvl
