If you are in combat with the opposing faction, at a battlepoint, regardless of region status, you can be attacked, by anyone.
Do you not read the news, or simply lack the capacity to comprehend it?

The Emethorn log that you are refering to is 2months old or something
they changed BP's shortly after this, check the news and you will find out how old it is, and about the trigger, Maybe i wanted to attack at the BP so the guards wouldnt block me? which the would have done if i had attacked earlier

Maybe Draco typed 'takeover'. It automatically makes you guard, and if you guard, you can be attacked at a BP.

Alias: kk (trigger Commander of Gondor todo backstab emethorn) altered.
Dalkar, the only trigger Grozdol ever had in this log was to hunt Draco on his name. And attacking him at the BP was possible without bugs.
Jaron, there is no reason for him to trigger a battlepoint to initiate combat if the other battlepoints were taken, he could have otherwise initiated anytime.
And Trempk, this log is three, maybe four boots old at most. Tlaloc and I quested the MELS, and megs were storing it.
These are probably old logs from when failkill didn't apply to the battlepoints
Are you 100% positive that the other battlepoints of the region were not under ER control?
Once upon a time, there was a fix saying you could not attack at battlepoints in a contested region, and you could only when it was being contested. So, does this qualify as bug abuse?
How the hell do you attack someone after the region is taken over?
