Hmm seems to me that he had the phial on the ground... That would explain why his sword got sheathed when he drank it. I believe you would pick up the phial upon consumption, just like wines and such. I see no phial on the ground though, he either accidently deleted it when he was adding in his comment or did it on purpose :)
Its called 'drop phial' then 'get staff from sling/cloak/pack/etc.' or 'draw sword'
How can you have a phial when wielding an ess and having a staff?
Some kind of buggy 3rd hand ? or did you find a bug to make a phial get out of your hand in your inventory?

i never knew he unfaded, i always thought he would backstab me if i didnt attack quick... just like the one with the BS cloak
