When it first came out you could tell who it was regardless of light levels, but that was within like a day of it being implemented when it was still bugged (before the fade change and stuff) so for all I know it could have been changed since then. But as far I know, you can't investigate.
Maybe if you where blinded?

Only if you want their weapon, in which case it still isn't worth not fading for, most of the time.
I like to see merciful used. if the goal is their eq, you dont need to kill and merciful becomes most useful.
